Electronic Digital Signature: Legal Aspects of Use

In 2009, the issue of using an electronic digital signature (EDS) gained particular relevance for Ukrainian enterprises and state institutions. The issue of organizational implementation requires special attention. The mere presence of an electronic digital signature does not guarantee the legal impeccability of documents if there are no internal provisions, orders, and regulations defining its use.

For state institutions and enterprises with a branched management structure, the implementation of EDS is not only a technical but also a managerial task. It is necessary to ensure:

• compliance of software with current legislative requirements;

• maintaining registers of electronic documents;

• monitoring certificate validity periods;

• backup and information protection.
